Acceptance of Terms

Welcome to Narraited Inc (Narraitet.com)! By accessing our website and/or using our mobile app (collectively referred to as “the Platform”), you agree to comply with and be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Platform.

Changes to the Terms

Narraited Inc reserves the right to modify or replace these Terms at any time. Notification of substantial changes will be provided through the Platform. It is your responsibility to review the Terms periodically for changes. Your continued use of the Platform after any changes constitute acceptance of those changes.

User Accounts

a. Account Creation

To access certain features of the Platform, you must create a user account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

b. Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify Narraited Inc of any unauthorized use or suspected breach of security.

c. Account Access

By creating an account, you acknowledge that certain features of the Platform are accessible only through the use of your account. You agree to access the Platform solely through the interface provided by Narraited Inc and not through any automated means.

d. Free (Trial) Accounts

Narraited Inc may offer free or trial accounts with limited access to certain features of the Platform. The duration and features of the trial may vary. Narraited Inc reserves the right to modify or terminate trial accounts at its sole discretion without notice and to convert trial accounts into paid accounts upon the expiration of the trial period.

e. Paid User Accounts

Certain features of the Platform may only be accessible through paid user accounts. By subscribing to a paid user account, you agree to pay the applicable fees as outlined in the pricing or subscription terms provided by Narraited.com. Payment may be required in advance, and fees are non-refundable except as expressly set forth in the refund policy.

f. Account Termination

Narraited Inc reserves the right to suspend or terminate your account at its sole discretion, without notice, for any conduct that it believes violates these Terms or is harmful to other users or third parties, or for any other reason. Upon termination, your right to use the Platform will immediately cease.

g. Data Accuracy

You acknowledge and agree that Narraited Inc may, in its sole discretion, preserve or disclose your account information if required to do so by law or in the good-faith belief that such preservation or disclosure is reasonably necessary to comply with legal requirements, enforce these Terms, respond to claims of wrongdoing, or protect the rights, property, or safety of Narraited Inc, its users, or the public.

Billing

a. Payment

If you subscribe to a paid user account, you agree to pay the applicable fees as outlined in the pricing or subscription terms provided by Narraited Inc. Payment may be required in advance, and fees are non-refundable except as expressly set forth in the refund policy.

b. Subscription Terms

By subscribing to a paid user account, you acknowledge and agree to the following subscription terms:

i. Subscription Plans

Narraited Inc may offer different subscription plans with varying features, durations, and pricing. The details of each plan will be clearly communicated on the Platform.

ii. Automatic Renewal

Paid user accounts may be subject to automatic renewal. By subscribing to a paid account, you authorize Narraited Inc to automatically charge the applicable fees to your chosen payment method on a recurring basis until you cancel your subscription.

iii. Cancellation

You may cancel your subscription at any time. The cancellation will take effect at the end of the current billing cycle, and you will retain access to the paid features until the end of that cycle.

c. Billing Information

You agree to provide accurate, current, and complete billing information, including a valid payment method. Narraited Inc reserves the right to suspend or terminate your access to the Platform if the billing information provided is inaccurate, incomplete, or not current.

d. Automatic Renewal

Paid user accounts may be subject to automatic renewal. By subscribing to a paid account, you authorize Narraited Inc to automatically charge the applicable fees to your chosen payment method on a recurring basis, if applicable, until you cancel your subscription.

e. Fee Changes

Narraited Inc reserves the right to change its fees and pricing for the Platform at any time. Fee changes will be effective as of the beginning of the next billing cycle. Narraited Inc will provide reasonable notice of any fee changes, and your continued use of the Platform after the effective date constitutes your acceptance of the new fees.

f. Refund Policy

Narraited Inc understands that circumstances may arise where you may seek a refund. The following refund policy applies:

i. Refund Requests

Refund requests must be submitted to Narraited Inc within 10 days from the date of the initial subscription or purchase.

ii. Eligibility for Refund

Refunds may be granted at the sole discretion of Narraited Inc and are subject to the following conditions:

• If technical issues prevent access to the Platform and are not resolved within a reasonable time frame.
• If a refund request is made within the specified refund period.

iii. Refund Process

If a refund is approved, Narraited Inc will process the refund within 7 days to the original payment method.

g. Taxes

You are responsible for any applicable sales, use, or other taxes associated with your use of the Platform. Such taxes will be added to the fees, as appropriate, and will be itemized on your billing statement.

h. Non-Payment

If Narraited Inc is unable to charge your payment method for any reason, or if a charge is disputed, Narraited Inc may suspend or terminate your access to the Platform until payment is received. Narraited Inc reserves the right to take appropriate legal action to recover outstanding debts.

i. Contact Information

It is your responsibility to ensure that your billing information, including your email address, is accurate and up-to-date. Narraited.com may use this information to contact you regarding billing issues or to provide important notices about your account.

Content

a. User-generated Content

Users may contribute content to Narraited Inc, including but not limited to text, images, audio, and video (“User Content”).

i. Ownership

You retain ownership of your User Content. Narraited Inc does not claim any ownership rights to the User Content you submit.

ii. Prohibited Content

You agree not to submit or share User Content that is illegal, defamatory, infringing on intellectual property rights, or violates any applicable laws. Narraited Inc reserves the right to remove any User Content that violates these Terms or is deemed inappropriate.

iii. Privacy of User Content

Narraited Inc respects the privacy of your User Content. We will not share, sell, or disclose your User Content to third parties without your explicit consent, except as required by law or as necessary to provide the services offered by the Platform.

iv. Content Moderation

Narraited Inc may, but is not obligated to, monitor, review, or moderate User Content. We reserve the right to remove or disable access to any User Content for any reason, without notice.

v. User Content Guidelines

You agree to adhere to any additional guidelines or rules provided by Narraited Inc regarding the submission of User Content. Failure to comply with these guidelines may result in the removal of your User Content and/or the suspension or termination of your account.

vi. Data Portability

While Narraited Inc respects your ownership of User Content, it is your responsibility to maintain copies of your content. Narraited Inc is not obligated to provide you with copies of your User Content after your account is terminated.

Privacy

Narraited Inc is committed to protecting your privacy. Please review our Privacy Policy to understand how we collect, use, and disclose your personal information.

Intellectual Property

All content on the Platform, including text, graphics, logos, and images, is the property of Narraited Inc or its licensors and is protected by copyright, trademark, and other intellectual property laws. Unauthorized use of the content may violate copyright, trademark, and other laws.

Termination and Account deletion

Narraited Inc reserves the right to suspend or terminate your access to the Platform at its sole discretion, without notice, for any conduct that it believes violates these Terms or is harmful to other users or third parties, or for any other reason. Upon termination, your right to use the Platform will immediately cease.

a. Request for Account Deletion

You have the right to request the deletion of your user account on our Platform. To initiate the account deletion process, please contact us at [support@narraited.com] from the email associated with your account, specifying your intent to delete your account.

b. Account Deletion Process

Upon receiving your request, Narraited Inc will verify your identity and, if the request is valid, commence the account deletion process. Please note that certain information may be retained for legal or legitimate business purposes, as outlined in our Privacy Policy.

c. Data Retention

Narraited Inc may retain certain data even after your account is deleted, as required by law or for legitimate business purposes. This may include, but is not limited to, backup copies of your User Content and transaction records.

d. Impact of Account Deletion

Deleting your account will result in the permanent loss of access to your user profile, User Content, and any associated data. Narraited Inc is not responsible for any loss of information that may occur as a result of account deletion.

e. Dispute Resolution and Appeals

If you believe that your account deletion request was improperly denied or if you have concerns regarding the process, you may contact our support team at [support@narraited.com] to initiate a dispute resolution or appeal process.

f. Termination of Services

Account deletion may lead to the termination of all services associated with your account. Any remaining subscriptions or access to paid features will be terminated, and no refunds will be issued for the remaining subscription period.

Disclaimers and Limitation of Liability

a. Disclaimers

The Platform is provided “as is” and “as available” without any warranties, express or implied. Narraited Inc is not responsible for any loss or damage resulting from the use of the Platform. To the fullest extent permitted by law, Narraited Inc disclaims all warranties, including but not limited to, the warranty of merchantability, fitness for a particular purpose, and non-infringement.

b. Limitation of Liability

In no event shall Narraited Inc, its affiliates, officers, employees, agents, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, including, without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Platform; (ii) any conduct or content of any third party on the Platform; (iii) any content obtained from the Platform; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not Narraited Inc has been informed of the possibility of such damage.

c. Liability Cap

Notwithstanding anything to the contrary in these Terms, the total liability of Narraited Inc and its affiliates, officers, employees, agents, and partners for any claim arising out of or relating to these Terms or the use of the Platform shall be limited to the amount you paid, if any, to Narraited Inc for the use of the Platform during the twelve months prior to the event giving rise to the claim.

Indemnification

You agree to indemnify and hold Narraited Inc, its affiliates, officers, employees, agents, and partners harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Platform or your violation of these Terms.

Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of Alberta, Canada. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Alberta, Canada.
